is a lease release?
A. It is a release form that can be used by a landlord
and a tenant, when the landlord has agreed to release a
tenant from the lease agreement before it is set to expire.
Both parties sign it, and it provides you, the tenant, with
an early release from your lease and its obligations.
Q. I am a commercial tenant, will your lease release
work for me?
A. Absolutely. Our lease release form can be used by commercial
tenants as well as residential tenants; in fact, it is specifically
designed to be applicable for both situations. As long as
both you and the landlord agree to terminate the lease agreement
then our lease release will work for you.
Q. When would I need to use a lease release?
A. There are a lot of different situations that can arise
which can cause you to need to be released
from your lease before its term has expired. Perhaps
you have gotten a job in a new state and you need to move
there as soon as possible. Maybe you have a sick family
member that you need to move in with and take care of, so
you can no longer stay in your apartment. Or maybe you yourself
have become ill, so that you can no longer run your business
and therefore you need to be released from your commercial
lease. For any of the aforementioned reasons, and for countless
others, you may need a lease release so that you can terminate
your lease early and not be held accountable for the remainder
of the lease term. Our lease release puts that agreement
into writing, so that you have proof that you were released
early from your lease term.
Q. Does my landlord have to approve of the lease
release?
A. Yes, a lease release
is not effective unless your landlord has agreed to release
you from the lease and will sign the form. Both signatures,
yours and the landlord's, are required on the lease release,
and the form is not binding unless it has been filled out
and it has both signatures. Therefore you will need to talk
with your landlord, possibly explain your situation, and
hopefully the two of you can come to an agreement and an
early release from your rental agreement will be allowed.
Remember though, for your legal protection you need to make
sure that the agreement is put into writing by using a lease
release to memorialize it.
